regard to this Railway, so far as it was known, was that the line was to be "constructed, marii equipped, and worked on behalf of the Imperial Chinese Government by the Deutsch-Asiatische Bank", though the capital was to be partly British and partly German. If this arrangement has been adhered to the position is a curious one, but the result would probablybe that the transport of food supplies for the German forces over this line would be a breach of neutrality. Apart however from the difficulty of the ownership of the railway, we would, if we raised any objection, be met with the legal diffi- culty as to whether land transport of food stuffs which will pro- bably reach a belligerent military and naval base, but which cannot be marked as intended for the belligerent's armed forces, is any breach of neutrality even if carried out over a railway which is worked on behalf of the neutral state.

The point of distinction between such a case and that of the Hongkong food supply by the Canton River is that in the latter case there is no transport by any railway or shipping belong- ing to the neutral state itself. The supply comes dom in ships belonging to private persons and in many cases in British ships.

Under all the circumstances of the case I would not advise any protest being made without a reference to the authorities
at home.
